The family of a Wichita boy killed when he was run over in a McDonald’s drive-through is suing the restaurant owner.
3-year-old Cody Schuber was killed in February 2007.
The family’s wrongful death lawsuit claims the restaurant’s design creates a blind spot, making it impossible for drivers and pedestrians to see each other.
The suit says the accident occurred as Cody tried to catch up with his twin brother. The boys were leaving the restaurant with their grandparents.
The suit says another child suffered a broken leg less than a year earlier, after being struck by a van in the same location.
McDonald’s franchisee Roy McCalla declined to comment on the lawsuit, saying it would not be appropriate.
