A Clay County judge will consider a settlement proposal this week in a lawsuit claiming a local Domino’s franchisee failed to pass along a delivery fee to the drivers who delivered pizzas, according to records filed in the case.
The class-action lawsuit filed Sept. 2 in Clay County District Court claims that Northern Empire Pizza Inc., a Fargo-based company with Domino’s locations in Moorhead, Fergus Falls, Crookston and Thief River Falls, withheld the delivery fees ranging from $1.50 to $1.99 even though Minnesota wage laws require such fees to go to delivery staff.
